Terms of Use

Welcome to the Hoot Hoot (“Website”). Please take a moment to read these terms and conditions (“terms”) to understand how they apply to your use of the Website and any products (“Products”) or services (“Services”) that you may order online.

These terms apply to all purchases made online through hoothoot.co.za. By using and/or registering on the Website, you agree to comply with these terms. Certain clauses, which may limit our responsibility or involve some risk for you, are highlighted for your attention. Please ensure you fully understand these clauses before using the Website or making a purchase.

1. Online Registration

  • Registration: You must register before placing your first order on the Website. Registration is free and does not oblige you to purchase anything. By registering and/or using the Website, you accept and agree to be bound by these terms.
  • Personal Information: To register, you will be required to provide certain personal information, which will be protected in accordance with our Privacy Policy. You must provide a valid email address and create a password, which will serve as your login credentials for future visits. Keep your password secure, as we will not be liable for any losses incurred due to unauthorized use of your account.
  • Account Management: You are responsible for ensuring that your registration information is accurate and up to date. You can update your details in the “My Profile” section of the Website. Upon registration, an email confirmation will be sent to the email address you provided.

2. Products

  • Product Descriptions and Images: We make every effort to display Products as accurately as possible on the Website, including images, features, and descriptions. However, the actual Product delivered may vary slightly in appearance, especially due to changes in packaging. Product descriptions and model numbers will take precedence over images in case of any disputes.
  • Colours: Due to differences in screen displays, we cannot guarantee that the colours of Products will appear exactly as they do on your monitor.

3. Product Pricing, Availability, and Delivery

  • Pricing: Prices displayed on the Website are valid only in South Africa and for the day on which they are viewed. Prices may change without notice, and such changes will not affect orders already placed. All prices include VAT unless stated otherwise. Special promotions may be subject to additional conditions, such as stock availability and limited-offer stipulations.
  • Availability: While we strive to ensure the availability of Products, we cannot guarantee that items will be in stock. If a Product becomes unavailable after you place an order, we will contact you to offer alternatives or a refund for the unavailable items.
  • Delivery: Delivery is only available within South Africa. Delivery areas are determined by your address at checkout. It is your responsibility to ensure that the delivery address provided is correct. Delivery fees will be calculated at checkout based on your location and the value of your order. We reserve the right to change delivery fees without prior notice.

4. Inadvertent and Obvious Errors

  • Errors: While we take all necessary precautions to provide accurate information on the Website, errors may occur. In the event of an inadvertent or obvious error in the price, Product description, or other content, Hoot Hoot is not obliged to honour the affected Product or Service. We will make every effort to contact you and inform you of the error. You will have the option to cancel the purchase, in which case we will provide a full refund for any amounts paid.

5. Orders

  • Confirmation of Orders: When you place an order, it constitutes your offer to purchase Products or Services subject to these terms. Upon receiving your order, we will send you an email confirming the Products and Services you have ordered. This email confirms receipt of your order but does not represent acceptance of your offer to purchase. We are not legally obliged to provide Products and Services until your order has been accepted and dispatched.
  • Order Cancellation: If you wish to cancel an order, you may do so by contacting us at info@hoothoot.co.za before the order is dispatched. If the order has already been dispatched, you will be responsible for any return delivery costs. We reserve the right to cancel your order in cases of a breach of these terms or for reasons such as non-payment.
  • Order Tracking: You can track the status of your order by logging into your account and selecting the “My Orders” section. Additionally, we will send you updates via email or SMS on the progress of your order.

6. Delivery

  • Delivery Fees: A delivery fee of quoted from courier partner will apply to orders under R500. Orders over R500 qualify for free delivery. Delivery fees are subject to change, and any applicable fees will be displayed at checkout.
  • Delivery Timeframes: Delivery typically occurs within 2 to 5 working days, depending on the Product and your location. In the event of unavoidable delays, we will notify you via email or phone.
  • Delivery Process: On delivery, you will receive a delivery note listing the items delivered. The person accepting delivery must present valid identification for verification. If no one is present at the delivery address, the courier will leave a notice and attempt to contact you to reschedule delivery. Additional delivery charges may apply for repeated delivery attempts.

7. Payment

  • Payment Methods: We accept various payment methods, including credit card and EFT. Payments must be made in full before Products are dispatched. Should payment fail for any reason, we reserve the right to cancel your order.
  • 3D Secure: We use 3D Secure for added protection during online payments. This requires verification of your identity by your bank before processing payment.

8. Returns and Refunds

  • Returns: You may return a Product to us in accordance with our Returns Policy, provided that it is in its original condition and you have the original proof of purchase. The cost of returning Products will be borne by the customer unless the Product is defective or delivered in error.
  • Refunds: Refunds will be processed back to the original payment method and account used during purchase. Refunds may take up to 7 business days to reflect in your account. EFT refunds are subject to verification of your banking details.

9. Risk and Ownership

  • Risk of loss or damage to Products passes to you upon delivery. Ownership of Products remains with Hoot Hoot until full payment has been received.

10. Product Reviews

  • By submitting a review, you confirm that your review is accurate and based on your genuine experience with the Product. Hoot Hoot reserves the right to edit, refuse, or remove reviews that violate our guidelines.

11. Marketing and Promotions

  • By completing a purchase, you may consent to receive marketing communications from Hoot Hoot. You can unsubscribe at any time using the link provided in our emails. Promotional offers are valid for a limited time and may be subject to stock availability and other conditions.

12. Intellectual Property

  • All content on the Website, including trademarks, logos, images, text, and other materials, is the intellectual property of Hoot Hoot or its licensors. You may not use, reproduce, or distribute any content from the Website without prior written permission.

13. Privacy and Data Use
